Booking terms

The original text is Croatian; section 12 explains how any difference between versions is interpreted.

1. Who provides the service

The accommodation is provided by Dinka Boban, a private household accommodation provider (iznajmljivačica u domaćinstvu), Mala Duba 89, 21329 Živogošće, Croatia (hereinafter “we”). E-mail: info@maladuba.com.

2. How to book

  1. Send a booking enquiry through the form on the website or by e-mail. The enquiry is free of charge and does not bind you or us.
  2. Within 24 hours we reply by e-mail with an offer (apartment, dates, number of guests, total price, amount of the deposit (kapara), payment details and payment deadline) or with a notice that the dates are not available. The offer also includes our telephone number.
  3. The booking is confirmed when the deposit reaches our account within the deadline stated in the offer. The contract is concluded at that point. We send you the confirmation by e-mail.
  4. If the deposit does not arrive by the deadline, the offer expires and the dates are released. If the deposit arrives after the deadline and the dates are no longer available, we refund it in full; if the dates are still available, we confirm the booking by e-mail.

3. Price

Prices are in euros, per apartment per night, and include the tourist tax, bed linen, towels (not beach towels), cleaning, Wi-Fi, air conditioning and a parking space. The total price in the offer is final; no additional costs that are not stated in the offer are charged.

4. Deposit

The deposit (kapara) is €100 per apartment and is paid by bank transfer (SEPA, in euros) to the host’s account:
beneficiary Dinka Boban, Privredna banka Zagreb d.d., IBAN HR50 2340 0093 1037 0454 6, BIC/SWIFT PBZGHR2X, payment reference: guest’s name and dates of stay.

We agree the payment deadline with you and state it in the offer. The payer bears the charges of their own bank.

The deposit is deducted from the price of your stay.

5. Balance

The balance is paid on site, in cash.

6. If you cancel

You may withdraw from the booking no later than check-in on the day of arrival, by sending a message to info@maladuba.com. In that case the deposit is not refunded, and you have no further obligations beyond the deposit. The same applies if you do not arrive. The deposit is agreed as a withdrawal fee (odustatnina; Obligations Act – Zakon o obveznim odnosima, ZOO, Art. 307). Illness or other personal reasons do not change this rule; we recommend travel insurance covering cancellation.

7. If we cancel

If we withdraw from a confirmed booking (no later than your check-in on the day of arrival), we refund you double the amount of the deposit (Obligations Act (ZOO), Art. 307).

If the stay becomes impossible because of an extraordinary event for which neither the guest nor the host is responsible and which could not have been foreseen or prevented (e.g. earthquake, flood, fire, an official ban on staying), the deposit is refunded in full (Obligations Act (ZOO), Art. 373).

8. Changes and shortening your stay

We will try to agree a change of dates or number of guests, subject to availability. Until we confirm the change by e-mail, the original booking applies.

If you shorten your stay or leave early, all booked nights are payable.

9. Right of withdrawal within 14 days

Because the accommodation is booked for specific dates, you have no statutory right to withdraw from the contract within 14 days, which otherwise applies to distance contracts (Consumer Protection Act (Zakon o zaštiti potrošača, ZZP), Art. 86(1)(12)). The right to withdraw while losing the deposit under section 6 still applies.

10. Rules for your stay

  • Arrival (check-in) from 2 pm, departure (check-out) by 10 am.
  • The minimum stay is 7 nights.
  • Arrival is on Saturdays, departure on Saturdays or Wednesdays.
  • An apartment can accommodate no more than 4 people (adults and children together).
  • Children are welcome. We do not have a cot or any children’s equipment.
  • Pets are not allowed.
  • Smoking is not allowed in the apartments; it is allowed on the terrace.
  • Parties are not allowed; quiet hours start at 10 pm.
  • By law we must register the stay of all guests within 24 hours of arrival, so on arrival we need an identity document for each person. We return the documents immediately after registering them.
  • House rules: FAQ – house rules (e.g. please switch off the air conditioning when you leave the apartment).

11. Complaints

You can submit a written complaint by e-mail to info@maladuba.com, by post to the address in section 1, or at the property. We confirm receipt in writing without delay and reply within 15 days at the latest.

Out-of-court dispute resolution: we have not committed in advance to taking part in proceedings before a body for alternative resolution of consumer disputes. If we do not resolve the dispute through the complaint, our reply will tell you which bodies you can turn to and whether we will take part in the proceedings. The list of bodies is published by the ministry responsible for consumer protection: https://www.szp.hr/imate-potrosacki-spor/alternativno-izvansudsko-rjesavanje-sporova-adr

12. Governing law and language

Croatian law applies to the contract; this does not exclude mandatory consumer protection rules. The original text of these terms is Croatian; if a translation differs, the interpretation more favourable to the guest applies.
